Joint 7/12 land sale in Maharashtra: what is changing and what buyers must check
A joint 7/12 land sale in Maharashtra now needs either an official 'C' copy of the land measurement record or written consent and an NOC from every co-owner. The rule was reported on 22 October 2026 as a Revenue Department circular.

Key points
- Since the circular reported on 22 October 2026, a sale of a share in joint 7/12 land can be registered without other co-owners' consent only if an official 'C' copy of the land measurement record is attached.
- Without the 'C' copy, the sub-registrar cannot register the sale unless every co-owner named on the 7/12 gives written consent and a No Objection Certificate.
- The 'C' copy is issued by the Land Records Department, so a buyer of part of a plot should ask for it before paying a token amount.
- This is a Revenue Department circular, not a new Act, and its text was not on an official site when this post was written.
- Before any token payment, read every name in the 7/12 owner column and verify the 7/12 with the issuing portal's verification number.

A joint 7/12 land sale in Maharashtra now needs one of two things at the sub-registrar's office: an official 'C' copy of the land measurement record, or written consent and a No Objection Certificate (NOC) from every co-owner named on the 7/12. News reports appeared on 22 October 2026 describing a Revenue Department circular, and one report dates the circular itself 19 October 2026 [5]. The decision was taken on the instructions of Chief Minister Devendra Fadnavis [2].
Joint 7/12 land sale in Maharashtra: what the circular changes
Sub-registrars may not register a sale deed for a share of jointly held land unless one of two sets of papers is produced [1][2]. If the seller attaches the official 'C' copy from the Land Records Department, no separate consent from other co-owners is needed. If the 'C' copy is missing, every co-owner on the joint 7/12 must sign a written consent letter and an NOC [2][3].
The aim is to stop individual co-owners from selling portions of jointly held land without the others' knowledge. Buyers have been cheated this way, and families have ended up in disputes over it [3]. The Revenue Minister, Chandrashekhar Bawankule, led the initiative [4]. The Divisional Commissioner's role in land revenue matters is set by the Maharashtra Land Revenue Code, 1966, which makes the Commissioner the chief controlling authority in a division, subject to the State Government's control [6].
What the 'C' copy is
The 'C' copy is an official copy of the land measurement record that the Land Records Department issues, and it relates to the measurement and division of the land [4]. The Marathi reports write it as 'क' प्रत [4], and one English report calls it a 'KA' copy [5]. The two names most likely refer to the same document, since the Marathi letter क is the source of both. Check the copy's exact name against the circular before relying on it.

Where the measurement record fits
A co-owner's share in a joint 7/12 is not the same as a physically marked part of a survey number. Marking off a part is a sub-division. Under the Maharashtra Land Revenue (Revenue Surveys and Sub-Divisions of Survey Number) Rules, 1969, a holding smaller than the minimum area is measured separately and entered in the land records as a sub-division of that survey number [7]. Before field work starts, the talathi must serve an individual notice on the holder, naming the numbers to be measured and the date the work begins [7].
Measurement is slow. In March 2026 the state announced licensed private surveyors in every district, because applications are rising and government staff are short [8]. A 30-day target for measurement cases has been reported, against a backlog of over 3.12 crore pending cases [9].
The boundary itself is still fixed only by a DILR measurement (mojni). Map outlines and a 7/12 do not do that job.

What to check before paying a token amount
Read the owner column of the 7/12. More than one name means the land is held jointly, and the circular applies. See how to read a 7/12 extract.
Ask the seller for the official 'C' copy from the Land Records Department, and check that it covers the land being sold.
Verify the 7/12 the seller gives you with the issuing portal's verification number, using the 7/12 verification tool.
Implications and execution
For families, the rule makes it harder for one co-owner to sell a share without the others, and the sub-registrar's counter becomes the checkpoint. For buyers, it adds a document to request before any token changes hands. Execution happens at registration, so a missing 'C' copy or a co-owner who cannot be reached, including one living abroad, can stop the deal. A commentary on the circular cites Section 44 of the Transfer of Property Act, 1882, which allows a co-owner to transfer an undivided share without the others' consent [5]. That is why the circular sets a document test rather than a ban. The circular text was not on an official site when this post was written, so check its wording with the sub-registrar office or a licensed advocate before acting. A separate October 2026 circular covers flats and units in construction projects and does not govern plots [10].

Questions this post answers
- Does selling a share of a joint 7/12 plot in Maharashtra need every co-owner's consent?
- Not if the seller attaches the official 'C' copy of the land measurement record from the Land Records Department to the sale deed. If that copy is missing, the sub-registrar cannot register the sale unless every co-owner named on the joint 7/12 gives written consent and a No Objection Certificate. This is the position reported in October 2026 coverage of a Revenue Department circular.
- What is the 'C' copy of the land survey?
- It is an official copy of the land measurement record issued by the Land Records Department. Reports on the October 2026 circular say the sub-registrar accepts it in place of other co-owners' consent when it is attached to the sale deed. Ask the seller for it and check that it covers the land being sold.
- Is the joint 7/12 rule a new law in Maharashtra?
- Reports describe it as a circular issued by the Revenue Department and dated October 2026, not a new Act. Sub-registrars follow it at registration. Check the exact circular text with the sub-registrar office or a licensed advocate, because the text was not on an official site when this post was written.
- Does a share of a joint 7/12 plot count as a marked part of the plot?
- Not automatically. A co-owner's share is an interest in the whole holding, while a physically marked part of a survey number is a sub-division. A sub-division needs measurement by the Land Records Department and an entry in the land records, so ask whether the part being sold has been measured and recorded.
